These Terms and Conditions ("Terms") govern your access to and use of the website www.birnagar.org ("Website"), operated by Kirtan Seva Trust ("Trust", "we", "our", "us"). By accessing, browsing, or using this Website, including making a donation, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, you are advised not to use this Website.
1. About the Trust and the Website
Kirtan Seva Trust is a charitable and spiritual trust engaged in devotional, educational, cultural, and religious activities. The Website is created to:
- Share information about the Śrī Śrī Rādhā-Kṛṣṇa Temple Development Project at Birnagar
- Spread awareness about Śrīla Bhaktivinoda Ṭhākura, his teachings, writings, and devotional contributions
- Provide updates regarding temple construction, events, and outreach programs
- Facilitate voluntary donations and pledges from well-wishers and devotees
The Website is informational and devotional in nature and does not engage in the sale of goods or commercial services.
2. Eligibility to Use the Website
By using this Website, you represent that:

3. Donations and Contributions
3.1 Nature of Donations
- All donations made through the Website are voluntary contributions.
- Donations are offered as seva (devotional service) and do not constitute any purchase or entitlement.
- No material goods, services, or benefits are guaranteed in exchange for donations.
3.2 Donation Options
Donors may choose:
- One-Time Seva
- Monthly Seva
- Quarterly Seva
- Yearly Seva
Donors may also:
- Select from predefined suggested amounts
- Enter a custom amount of their choice
4. Payment Processing
- All payments are processed exclusively through third-party payment gateway service providers.
- The Website itself does not process, store, or handle any financial or payment-related information.
- Payment gateway providers are responsible for transaction security, processing, authorization, and completion.
- Any issues related to payment failure, delay, or processing must be addressed with the respective payment gateway.
5. Recurring Donations
- If a recurring seva option is selected, the payment gateway may automatically process future donations as per the selected frequency.
- Donors may modify, pause, or cancel future recurring donations through the payment gateway's interface or by contacting the Trust.
- Any donation already processed before cancellation shall be considered complete and non-refundable.
6. Refund and Cancellation Policy
All donations and contributions made to the Birnagar Project are voluntary and are used towards the development of the temple and associated initiatives.
Once a donation has been successfully processed, it is considered final and non-refundable. We do not entertain requests for refunds or cancellations under normal circumstances.
In case of any duplicate transactions or technical errors resulting in an unintended payment, donors may contact us within 7 days of the transaction. Such requests will be reviewed on a case-by-case basis, and any decision made by the organization shall be final.

7. Use of Donation Funds
All funds collected through the Website shall be utilized for purposes including but not limited to:
- Temple construction and development
- Maintenance of temple premises and facilities

The allocation and use of funds are governed by Trust policies and spiritual oversight.
8. Tax Exemption
The Birnagar Project operates under a registered charitable entity holding valid registration under Section 12A of the Income Tax Act, 1961.
However, donations made to the organization are currently not eligible for tax deduction under Section 80G of the Income Tax Act. Donors are advised to consider this before making contributions.
Any updates regarding tax exemption status will be communicated through official channels.
